1. Who we are and what these Terms cover
These Terms of Use (the "Terms") are a legal agreement between you and Flytte ("Flytte," "we," "us," or "our"). These Terms govern your access to and use of Flytte, including the Flytte iOS app, Apple Watch companion app, supporting web app, related APIs and services at flytte.org, public activity pages, live-sharing link fallbacks, and any support or account features we provide (collectively, the "Service").
By creating an account, downloading the app, accessing the Service, or using any Flytte feature, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect information. It also explains your privacy settings, account export and deletion options, and how location, activity, Apple Health, HealthKit, Apple Watch, social, community, moderation, notification, and AI-related data are handled. The Privacy Policy is part of these Terms.
3. Eligibility
Flytte is for adults only. You must be at least 18 years old to create an account or use the Service. By using Flytte, you represent that you are at least 18 years old and can form a binding contract with Flytte.
You may use the Service only if you are not barred from using it under applicable law. If you use Flytte on behalf of an organization, club, or team, you represent that you have authority to bind that organization to these Terms.
4. Accounts and security
You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You may not share your account, use another person's account without permission, or create an account using false, misleading, or unauthorized information.
Flytte may provide account features such as email verification, password reset, session and device management, security notices, account export, and account deletion. You are responsible for all activity that occurs under your account unless caused by Flytte's failure to protect the Service. Notify us promptly at hello@flytte.org if you suspect unauthorized access to your account.
5. The Service
Flytte is a social fitness tracking platform. Depending on enabled features and permissions, the Service may allow you to record activities, manually create activities, import GPX/FIT/TCX files, import Apple Health workouts, sync Apple Watch workouts, connect approved device integrations, view activity history and metrics, upload activity media, discover and save routes, follow routes while recording, compare efforts on route sections, join clubs and challenges, post or comment in community areas, receive notifications, use optional live sharing, and receive activity insights or workout recommendations.
We may add, change, suspend, or discontinue features at any time. Some features depend on your device, permissions, network connection, Apple platform services, third-party services, provider approvals, or location and sensor quality.
6. Fitness, medical, location, and safety disclaimers
Flytte is a fitness and social activity service. It is not a medical device, medical provider, healthcare provider, emergency service, professional coach, insurer, or substitute for professional medical advice. Activity insights, training suggestions, AI-assisted outputs, metrics, maps, routes, route sections, live-sharing status, notifications, and achievements are provided for general fitness and informational purposes only. They are not medical advice, injury diagnosis, treatment, readiness guarantees, performance guarantees, or safety guarantees.
Use common sense, consult a qualified professional before beginning or changing an exercise program, and stop exercising if you experience pain, dizziness, shortness of breath, or other concerning symptoms. You are responsible for your health, safety, surroundings, route choices, equipment, and compliance with traffic, trail, event, park, and local rules.
GPS, heart-rate, pace, elevation, route-following, live-sharing, and leaderboard data can be inaccurate, delayed, interrupted, or unavailable. Flytte may not record continuously during force quit, device restart, operating-system termination, poor GPS, Low Power Mode, poor connectivity, permission changes, hardware limitations, or other conditions. Live sharing is not an emergency response system and should not be relied on to keep you safe.
7. Permissions and integrations
Certain workflows require permission to access device features or third-party services. Location permission supports active iPhone recording, route capture, route following, and live sharing. Health/Workout permission supports Apple Watch workouts and Apple Health workout imports. Photos or picker access supports activity media. Push notification permission supports optional Apple Push Notification service delivery.
Flytte requests health, workout, motion, location, photo, and notification permissions only for user-facing workflows. You can usually revoke device permissions through iOS settings or disable integrations through Flytte where supported. Revoking permission may limit or disable related features. Third-party services, including Apple platform services and connected-device providers, are governed by their own terms and privacy practices.
8. User Content
"User Content" means content or data you submit, upload, create, import, post, or make available through the Service, including profile information, activities, routes, route sections, maps, GPS traces, activity files, media, captions, comments, posts, reactions, club or challenge content, reports, and support requests.
You retain ownership of your User Content. You grant Flytte a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, reproduce, display, publish, transmit, distribute, modify, and create technical or functional derivatives of your User Content as needed to operate, provide, secure, moderate, support, improve, and develop the Service, and to make User Content available to other users according to your privacy settings and the product features you use.
You represent that you have the rights needed to submit your User Content and grant this license. You are responsible for your User Content and for any consequences of sharing it, including activity location information, home/work proximity, photos, comments, and club or challenge posts.
9. Privacy settings, visibility, and sharing
Flytte is a social product, but privacy controls matter. The Service may support activity visibility settings such as public, followers-only, and private; profile visibility controls; route privacy controls; hidden start/end controls; blocking; and manual, follower-gated live sharing.
Your settings affect how Flytte serves content, but people who can view your content may still save, copy, screenshot, or share it outside Flytte. Public activity pages and live-sharing fallback pages are intended to show only privacy-safe information, but you should avoid posting information you do not want others to know.
Routes can have visibility that is independent from activities. A route linked to an activity may be hidden from viewers who are not allowed to see both the activity and the route.
10. Health, fitness, and location data commitments
Flytte collects and uses health, fitness, workout, route, and location information to provide and improve the fitness features of the Service, including activity recording, Apple Watch workouts, Apple Health imports, maps, route following, route discovery, route-section comparisons, live sharing that you manually start, training insights, support, safety, security, debugging, and legal compliance.
Flytte does not use or disclose health, fitness, workout, medical-research-context, or precise location information for third-party advertising, Flytte advertising or marketing, unrelated data mining, or sale to data brokers. Flytte does not currently use advertising SDKs, marketing SDKs, or analytics SDKs.
11. Community, competition, and prohibited conduct
You agree not to misuse the Service. Prohibited conduct includes harassment, threats, hate, bullying, doxxing, stalking, spam, scams, impersonation, illegal activity, non-consensual or invasive content, infringement of intellectual property or privacy rights, uploading malicious code, probing or attacking the Service, scraping or harvesting data without permission, bypassing access controls, reverse engineering except where legally permitted, or using the Service in a way that harms Flytte or other users.
You also agree not to manipulate activity data, GPS traces, route-section efforts, leaderboards, challenges, achievements, or community features. Flytte may remove, hide, re-rank, recalculate, or investigate efforts, routes, activities, posts, comments, or accounts that appear inaccurate, abusive, suspicious, or inconsistent with these Terms.
12. Moderation and enforcement
Flytte may review reports, support requests, content, account activity, and technical records to operate the Service, enforce these Terms, investigate safety or abuse issues, respond to legal requests, and protect users and the Service. We may remove content, limit visibility, disable sharing, suspend features, revoke sessions, deactivate accounts, or terminate accounts where appropriate.
We are not obligated to monitor all content or resolve every dispute between users. If you believe content violates these Terms, report it through the Service or contact hello@flytte.org.
13. AI-assisted features
Flytte may offer AI-assisted features, such as Activity Insights, Next Best Workout copy, and Suggested Goals copy. These features are part of the Service and are not currently subject to a separate user-level opt-out setting. You can choose not to view or use particular AI-assisted outputs where the app presents them, but Flytte does not currently provide a global AI opt-out while maintaining an account.
AI-assisted features are informational only and may be incomplete, inaccurate, unavailable, or replaced by deterministic fallback copy. AI output is not medical advice, injury diagnosis, or a guarantee of readiness, safety, or performance.
Do not rely on AI output as your sole basis for training, health, safety, or route decisions. Use your own judgment and consult qualified professionals where appropriate.
14. Communications and notifications
We may send transactional messages related to your account, security, verification, password reset, support, reports, moderation, imports, service updates, and other operational matters. Push notifications are optional and can be managed through Flytte settings and device settings. You may still receive non-promotional service or security notices even if you disable optional notifications.
Flytte does not currently send advertising or marketing messages based on health, fitness, workout, or precise location information.
15. Account export, deletion, and retention
Flytte may provide self-service account export and account deletion features. We generally retain information for as long as you maintain an account or as needed to provide the Service.
You may delete your account and request deletion of your data at any time through available account settings or by contacting us. Account deletion may deactivate the account, revoke sessions, disable push/device connections, scrub public profile fields, reset privacy defaults, and sign you out. Some deletion workflows may take time to complete, including backup handling and object-storage cleanup.
Please note that your right to deletion is limited in certain circumstances, such as when the law requires us to retain information. Some information may also be retained where needed for security, legal compliance, safety, abuse prevention, operational integrity, moderation, audits, backups, legal claims, or to complete deletion workflows. See the Privacy Policy for more detail on retention, account export, and deletion.
16. Flytte ownership and intellectual property
Flytte and its licensors own the Service, including software, interfaces, designs, text, graphics, logos, trademarks, service marks, source code, object code, APIs, documentation, and other materials, except for User Content and third-party materials. These Terms do not transfer any ownership rights to you.
Subject to these Terms, Flytte grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial fitness and community purposes. You may not copy, modify, distribute, sell, lease, or exploit any part of the Service except as expressly permitted by Flytte or applicable law.
17. Feedback
If you submit feedback, ideas, bug reports, or suggestions, you grant Flytte a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.
18. Third-party services and links
The Service may interact with third-party services or platforms, including Apple services, Apple Health, Apple Watch, Apple Push Notification service, MapKit, transactional email providers, infrastructure providers, storage providers, AI infrastructure, and connected-device providers when enabled. Third-party services are not controlled by Flytte, and Flytte is not responsible for their content, availability, accuracy, security, or privacy practices.
Provider integrations may be unavailable until provider approval, webhook/sync processing, token refresh, backfill, and production validation are complete.
19. Apple App Store terms
If you download Flytte from the Apple App Store, these Terms are between you and Flytte, not Apple. Apple is not responsible for the Service, maintenance, support, claims, or warranties, except as required by law. You must comply with applicable Apple App Store terms and usage rules. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
20. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. Flytte disclaims all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, safety, data integrity, uninterrupted operation, and error-free operation.
Flytte does not warrant that any activity, route, metric, AI output, notification, live-sharing session, route-section effort, leaderboard, import, sync, or recording will be accurate, continuous, timely, safe, or available.
21. Limitation of liability
To the fullest extent permitted by law, Flytte and its officers, directors, employees, contractors, agents, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, personal injury, property damage, or service interruption, arising out of or related to the Service or these Terms.
To the fullest extent permitted by law, Flytte's total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of USD $100 or the amount you paid Flytte for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
22. Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Flytte and its officers, directors, employees, contractors, agents, affiliates, and licensors from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your use or misuse of the Service, your violation of these Terms, your violation of law, or your violation of another person's rights.
23. Suspension and termination
You may stop using the Service at any time and may delete your account through available account settings or by contacting us. Flytte may suspend or terminate your access to the Service, with or without notice, if we believe you violated these Terms, created risk or possible legal exposure for Flytte or others, or used the Service in a way that may harm users, Flytte, or the Service.
Sections that by their nature should survive termination will survive, including sections on User Content licenses, ownership, feedback, disclaimers, limitation of liability, indemnity, and any retention or enforcement rights.
24. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service, by email, or by other reasonable means. The updated Terms will be effective on the date stated. Your continued use of the Service after the effective date means you accept the updated Terms.
